Winter 2019 Snowbank Removal Notice

PW

With heavy and consecutive snowfalls, our snow maintenance crews have been working continuously to maintain our roads and sidewalks, as quickly and efficiently as possible. With early hours and late nights, our Operators work to clear snow before most people leave for work and continue until most are back home at the end of the day.

We understand that the accumulation of snowbanks has caused some frustration and we do appreciate your patience. The snow plowing and sanding of municipal roads are leading priorities for us. The Municipality is required by Provincial legislation to prioritize streets based on classification. Once all roads and sidewalks have been maintained and if downtime between snowfalls permits, snowbanks will be cleared based on priority. It is also imperative that we maintain our equipment in preparation for the next snowfall, all while managing hours of work to provide sufficient rest time for our operators.

Residential Snow Plowing and Removal Notice

A reminder that removing snow by pushing it on to or across a public road is dangerous and illegal as per By-Law 2006/63 and the Ontario Highway Traffic Act.

This practice can create a variety of safety hazards including but not limited to:

  • Creating frozen piles/ridges which usually causes extensive damage to Municipal snowplows
  • Most times kicking off the rear of our equipment onto the adjacent lane, creating a health and safety risk to oncoming traffic
  • Posing a danger to the plow operator and the travelling public
  • Creating the opportunity for increased drifting
  • Creating drainage obstruction in the spring
  • Creating additional snow accumulation for neighbours
  • Posing a danger to the person removing or pushing the snow

Please be mindful when cleaning up your driveways and entranceways.  Your assistance is appreciated and will allow us to continue to provide a safe and reliable road system for all our residents.

Notice of Passing of a Zoning By-Law (By-Law 2017/83)

NOTICE OF PASSING OF A ZONING BY-LAW

BY-LAW 2017/83
AMENDMENTS TO COMPREHENSIVE ZONING BY-LAW

TAKE NOTICE THAT the Council of the Corporation of the Municipality of West Nipissing passed By-law No. 2017/83 being an amendment to By-Law No. 2014-45 on the 21st day of November, 2017, under the provisions of Section 34 of the Planning Act, RSO 1990, c. P. 13.

AND TAKE NOTICE THAT any person or agency may appeal to the Ontario Municipal Board (OMB) in respect to the By-law by filing with the Clerk of the Municipality of West Nipissing, not later than 4:30 p.m. on the 19th day of December, 2017, a Notice of Appeal setting out the objection to the By-law, the reasons in support of the objection, and the fee required by the Ontario Municipal Board. The Notice of Appeal must be filed using the “Appellant Form”, a copy of which is available from the OMB website at www.omb.gov.on.ca.

ONLY INDIVIDUALS, CORPORATIONS AND PUBLIC BODIES may appeal a zoning by-law to the Ontario Municipal Board.  A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.

NO PERSON OR PUBLIC BODY shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Municipal Board, there are reasonable grounds to add the person or public body as a party.

PURPOSE AND EFFECT OF THE ZONING BY-LAW: Zoning By-law Amendment No. 2017/83

  1. Section 3, Definitions 3.183, 3.185 and 3.186 - to more clearly define the “required yard” as being what is required in the zoning by-law instead of from the lot line to the building;
  2. Section 4.2.3: The location of accessory buildings etc have been expanded to recognize them in front and exterior side yards, but not within the required yards; and in Section 4.2.9.4 and 4.2.10, the reference to requirements for two storey boathouses has been removed from the by-law, since two storey boathouses are not permitted in the Municipality;
  3. Section 4.10:  A home industry can be permitted on any size lot, where the original by-law required 1 hectare;
  4. Section 4.12: The buffer is appropriately referred to as “depth”;
  5. Section 4.16: The provisions have been modified for non-complying buildings and structures to provide more flexibility for the replacement of such structures where physical impediments preclude or impede compliance;
  6. Section 5.2.6: The maximum 8 metre width for a driveway has been removed, and now the requirement is that the driveway not exceed 50% of the frontage of the lot;
  7. Section 5.5.2:  The section on parking of boats and trailers has been modified to reflect use of utility trailers and to broaden where boats and trailers can be located on the lot;
  8. Table 6.3:  Revised to make it clear that the reduced minimum frontage and area applies only to semi-detached dwellings;
  9. Table 7.2:  Revised to make sure the zoning by-law does not go beyond the Building Code for residential uses in a non-residential building;
  10. Table 9.1:  Revised to prohibit residential uses from the remnant parcels of farms where a surplus dwelling has been severed from the property;
  11. Table 9.3:  The minimum lot area in the Rural zone has been reduced from 10 hectares to 4 hectares; and
  12. The schedules to the by-law have been changed to reflect previously approved surplus farm severances and zoning of the remnant parcels to A2.

The Comprehensive Zoning By-law applies to all lands within the Municipality of West Nipissing, therefore a key map has not been provided.

ADDITIONAL INFORMATION is available from the Municipal Office during regular office hours (8:30 a.m. to 4:30 p.m.).
