TAKE NOTICE that the Council for The Corporation of the Municipality of West Nipissing passed By-law No. 2023-47 on May 16, 2023, under Section 34 of the Planning Act, R.S.O. 1990, c.P.13. This by-law pertains to a Zoning By-law Amendment application (File No. ZBLA2021/16) to amend the Comprehensive By-law.
The purpose and effect of By-law 2023/47 is to amend Comprehensive Zoning By-law No. 2014-45:
1. Section 4.2 – Accessory Uses, Buildings and Structures: – to increase the minimum setback for accessory structures in the Rural (RU), Rural Residential (RR), Agriculture (A1) and Agriculture 2 (A2) from 1.2m to 3m.
2. Section 4.2.11 – Storage Containers/Galvanized Steel buildings – to permit one (1) only galvanized steel accessory structures in the .R- 1 R4 zones and to permit one shipping container OR one (1) galvanized steel structure in the SR zone provided that such lot have a minimum area of 4000m2 (1 acre) and that such storage container or galvanized steel building be subject to the provisions of accessory structures for the SR zone.
3. Section 4.28.1 – Temporary Uses – to permit a Storage Container or Trailer during construction, for up to one year, provided that an active building permit is in effect;
4, Table 6.3 – Maximum Number of Dwelling Units – to include new Planning Act provisions in Residential one and Residential Two (R1 and R2) zones and amend typographical error in Rural Residential (RR) and Shoreline Residential (SR) zones;
5. Note (b) – Tables 9.1 and 9.2: To amend notes in Tables 9.1 and 9.2 with respect to permitted uses in Rural (RU) zones for lots having an area less than 4 hectares.
All oral and written submission relating to the By-law were considered by Council before this decision was made.
The last date for filing a notice of appeal is June 19, 2023. Such notice of appeal must be filed with the Municipal Clerk of the Corporation of the Municipality of West Nipissing and must:
- be in writing;
- set out the reasons for the appeal;
- be accompanied by the Ontario Land Tribunal fee in the amount of $1,100.00, which can only be paid by certified cheque or money order made payable to the Minister of Finance, Province of Ontario.

Only individuals, corporations and public bodies may appeal a by-law to the Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.
No person or public body shall be added as a party to the hearing of the appeal unless, before the by- law was passed, the person or public body made oral submissions at a public meeting or written submissions to the Council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.
