Notice of Passing: Comprehensive Zoning By-law 2026-58

TAKE NOTICE THATthe Council for the Corporation of the Municipality of West Nipissing passed By-law No. 2026-58 on the 11th day of August 2026 under Section 34 of the Planning Act,R.S.O. 1990, c.P.13.

PURPOSE AND EFFECT

By-law 2026-58 is a Comprehensive Zoning By-law that applies to all lands within the Municipality of West Nipissing. A Zoning By-law, prepared under Section 34 of the Planning Act, is the Municipality’s primary tool to regulate land uses, building locations, and development standards such as height, setbacks, permitted uses, and parking requirements. The purpose and effect of By-law 2026-58 is to implement the policies and intent of the Municipality’s Official Plan adopted by Council in July 2026, and to ensure the regulations conform with related Provincial legislation and policy. By-law 2014-45 will repeal and replace Zoning By-law 2014-45, but will carry forward all site-specific exemptions made under By-law 2014-45.

WRITTEN AND ORAL SUBMISSIONS

Written and oral submissions were considered by the Council of the Municipality of West Nipissing as part of its deliberations and final decision on this matter.

WHEN AND HOW TO FILE AN APPEAL

An appeal to the Ontario Land Tribunal must be submitted within twenty (20) days of the notice of the decision. The last date for filing an appeal is September 8, 2026 at 4:30 p.m. Such notice must be filed with the Municipal Clerk of the Corporation of the Municipality of West Nipissing and must:

  1. be in writing;
  2. set out the reasons for the appeal; and
  3. be accompanied by the fee required by the Ontario Land Tribunal.

A notice of appeal may be filed either via the Ontario Land Tribunal e-file service at https://olt.gov.on.ca/e-file-service/ by selecting “West Nipissing (Municipality of)” or by mail to the address provided below. If the e-file portal is down, you can submit your appeal to the Municipal Clerk at mducharme@westnipissing.ca.

WHO CAN FILE AN APPEAL

As per the PlanningAct, any specified person, public body, or registered owner of any land within the Municipality that made oral submissions at a public meeting or written submissions to the Council may appeal to the Ontario Land Tribunal in respect of By-law 2026-58.

No person or public body shall be added as a party to the hearing of an appeal unless, before the by-law was passed, the person or public body made oral submissions at the public meeting or written submissions to the Council or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
